Due diligence includes reviewing, and providing analysis and guidance based on the applicable law, regulation, and policy on the following documents (generally to prepare for appraisal): record and non record title evidence and encumbrances, mineral rights, water rights, timber valuation, deed of conveyance, legal description, survey plat, and other documentation as applicable.
BTC will provide strategic procedural advice, curative advice and drafting, edits and comments on the deed, and an encumbrance evaluation spreadsheet.
Independent title review includes a review and analysis of the preliminary title report (a.k.a. title commitment) and other record title evidence as applicable, and non record title evidence against state and federal law, regulation, and policy.
An encumbrance evaluation spreadsheet will be provided along with strategic and procedural recommendations for clearing title (as needed).
Includes water rights research and due diligence on applicable state law, regulation, and policy; water resources board (or similar) query results. Summary and mapping of water rights provided.
