Due Diligence

Due diligence includes reviewing, and providing analysis and guidance based on the applicable law, regulation, and policy on the following documents (generally to prepare for appraisal): record and non record title evidence and encumbrances, mineral rights, water rights, timber valuation, deed of conveyance, legal description, survey plat, and other documentation as applicable. 

BTC will provide strategic procedural advice, curative advice and drafting, edits and comments on the deed, and an encumbrance evaluation spreadsheet.

Title Review

Independent title review includes a review and analysis of the preliminary title report (a.k.a. title commitment) and other record title evidence as applicable, and non record title evidence against state and federal law, regulation, and policy.

An encumbrance evaluation spreadsheet will be provided along with strategic and procedural recommendations for clearing title (as needed).

Mineral Rights

Includes mineral rights research, evaluation, and report.

Water Rights

Includes water rights research and due diligence on applicable state law, regulation, and policy; water resources board (or similar) query results. Summary and mapping of water rights provided. 

Hydrologist report available upon request.

Easement / Right-of-Way Review

BTC will work with you to identify and explain whether legal, physical access exists, and recommend curative actions in cases where access is needed.

Conservation Easement & Warranty Deed Review

Review with edits and comments/suggestions related to applicable law, regulation, and policy. 

Exhibits review included.

Legal Description & Surveys

Review of legal description to ensure consistency with related documents (e.g., survey plat and deed Exhibits). Will review against adjacent/abutting parcels as needed and compare against tax assessors information, and other GIS databases to ensure consistency and clarity. BTC provides a summary of errors and corrections needed as applicable.
